- 1. Commission Fee
If you find an apartment or room through "Crocodilian" we will charge you a commission based on the following conditions - Status from 13.1.2007: The maximum fee for flats is 145% of the monthly rent, for rooms 100%.

You only pay a commission, if you rent a room or a flat. The commission fee is due immediately, when the rental is agreed on either in oral or written form. You also receive an invoice from Crocodilian by email.
- 2. Collection expenses
A processing fee of 5 € will be charged for sending reminders. A fee of 10€ will be charged for the costs incurred on a returned direct debit order due to insufficient funds in the account or where the wrong details of the party liable for payment have been given.
3. Crocodilian will supply offers
"Crocodilian" will supply the customer with offers of rental properties which were previously unknown to him. Should the customer already have knowledge of an offer he must inform "Crocodilian" immediately and if requested provide proof of his previous knowledge. If he fails to do so, Crocodilian is entitled to charge the full commission fee if the contract is concluded.
4. Offers must be treated confidentially
All offers from "Crocodilian"must be treated confidentially. If this confidentiality is breached the customer is liable to "Crocodilian" for the commission fee which would have been due.
5. Crocodilian provides information - contract obligation of the client
"Crocodilian"merely provides information about accomodation and the possibility of a rental contract. Crocodilian offers own contract in English or German, but the obligations of the rental contract are solely the obligation of the client and the landlord. "Crocodilian"cannot be held responsible to any of the parties for a violation or breach of the rental contract.
6. Contract in oral or written form and extension of contract have to be reported within 24 hours
The finalisation of an oral or written rental contract for one of the offers given the client must be reported to "Crocodilian" by the tenant and the landlord immediately, at the latest within 24 hours. The extension of a contract also has to be reported to Crocodilian immediately and the commission fee is also due immediately.
7. Finding of other accommodation must be reported to Crocodilian
If the client finds accomodation from another source, he commits himself to report this to "Crocodilian".
8. Commission fee, invoice, credit card
The commission is based on the monthly rent given by the landlord in our offer, including bills unless they are listed seperately, and the rental period agreed by the landlord and tenant. If you rent an accommodation for less than a month, you pay 25% + VAT of the rent agreed with the landlord. The tenant will receive an invoice via email and we will debit his credit card. If an invoice via postal service is required, "Crocodilian" will charge 15€. Companies and institutions will receive an invoice via fax, if requested, free of charge.
If we cann't debit the credit card of the user of the accommodation, and he or she does not raise the credit limit, the landlord has the right to cancel the rental contract.
9. Early termination of contract- no return of commission fee
No claims can be made against "Crocodilian" in the case of an early termination of the rental contract. The full commission fee remains due according to the originally agreed rental contract. The commission fee will only be returned if the rental contract was terminated early because the landlord is proved not to have, or not to have been able to, fulfill his obligations under the terms of the rental contract.
10. Contract by using our service
By using our services you are entering into a contract with us and agree to abide by our conditions of service.
11. Non-liability clause
The details given by Crocodilian-Rooms in Berlin on the web site and the information about rooms and flats are based on the information supplied by the landlords offering the property. No warranty is given for the correctness of the details. If you want to make sure, that the information is correct, please ask for a written confirmation from the landlord.
12. In all other cases statutory provisions apply.
